The Lawyer Litigation Tracker Q1 2018: Julie Anderson in top 10 barristers appearing in Court of Appeal

The Lawyer published its Litigation Tracker England Wales Q1 2018 Report in April 2018 which included a summary of notable cases that reached judgment in Q1 of 2018 and their implications for the legal industry; league tables covering the most active firms, partners, chambers and barristers in Q1 of 2018 by number of cases and case days; and court by court analysis.

Julie Anderson was listed in the section of ‘Top 10 barristers in the Court of Appeal’ in terms of number of cases.

Julie was also mentioned in the section ‘Notable Cases – Court of Appeal’ for her involvement in DN (Rwanda) v The Secretary of State for the Home Department. In this case Julie acted for the Secretary of State. The Appellant argued that an earlier decision of principle of the Court of Appeal that determined his claim against him did not apply because the Court was always free to reconsider issues that bore on the right to liberty. The earlier decision established that an unlawfulness in a deportation decision (caused by reliance on a statutory order later set aside as ultra vires) did not automatically render unlawful in retrospect a decision to detain made in good faith when the order and deportation were believed to be lawful. Julie successfully argued for upholding the law of precedent. An application for permission to appeal to the Supreme Court is pending.
